1. Scope of Application
All deliveries and services provided by Grumania Jets are exclusively based on these General Terms and Conditions. They also apply to all subsequent transactions.
Deviating terms and conditions are only valid if agreed upon in writing. Conflicting terms and conditions, as well as any terms and conditions of the customer
that deviate from our General Terms and Conditions, are not recognized. They only become valid if confirmed in writing by our company.
2. Subject Matter of the Contract
The contractual service provided by Grumania Jets is limited to the delivery of the ordered goods for private use. The customer must inspect the goods
for completeness and integrity immediately upon receipt. Later complaints will not be accepted.
3. Offer and Contractual Obligation
Offers from Grumania Jets are generally non-binding with regard to price, availability, and delivery time; i.e., they merely constitute an invitation to the
customer to place an order. Correct and timely delivery by our own suppliers is always reserved. Order confirmations are also always non-binding with regard
to price, availability, and delivery time. The price valid on the day of delivery applies.
4. Delivery/Shipping
Delivery times and performance specifications are provided to the best of our knowledge based on the delivery days. Grumania-Jets is entitled to make partial
deliveries at any time. Partial deliveries are considered independent deliveries with regard to payment obligations, transfer of risk, and warranty
obligations. Grumania-Jets is also entitled to postpone delivery for the duration of any impediment plus a reasonable start-up period. Failure to meet
delivery dates does not release the buyer from their obligation to accept delivery. Any resulting claims for damages by the buyer are excluded. Deliveries
are generally not made as parcels or letters (uninsured) unless the customer expressly requests this in writing and no payment has yet been made via the
online shop. Deliveries already paid for as parcels preclude the request for parcel delivery in any case. For parcel or letter shipments, the customer
expressly accepts that written proof of shipment is not possible (no postal tracking number available).
4.1 Delivery Delays
Delivery delays caused by legal or official regulations (e.g., import and export restrictions) are not our responsibility. In important cases, Grumania-Jets
will inform the customer of the beginning and end of such obstacles as soon as possible. The delivery period may be extended by the time it takes for the
customer to provide Grumania-Jets with the information necessary for order fulfillment. In the event of delivery delays for which Grumania-Jets is not
responsible, Grumania-Jets is entitled to withdraw from the contract in whole or in part without prior notice.
4.2 Shipping
The risk passes to the buyer upon dispatch of the goods from the warehouse. Unless otherwise agreed, all deliveries are made via Deutsche Post AG.
Deliveries to other European countries are generally made against prepayment. Unless freight-free delivery has been agreed, shipping is at the buyer's expense.
The risk passes to the buyer as soon as the goods leave the warehouse. This applies regardless of who bears the transport costs. If dispatch or delivery is
delayed at the request of the customer, the risk passes to the customer from the day the goods are ready for dispatch.
The recipient must inspect the delivered goods immediately upon receipt and report any damage as necessary. The recipient must report any obvious or
discovered transport damage to the carrier or freight forwarder without delay and subsequently inform the seller in order to assert any claims against
the seller. Any transport damage must be confirmed by the carrier/freight forwarder with their signature immediately. Without confirmation from the
carrier/freight forwarder, a claim regarding transport damage is no longer possible. If the carrier/freight forwarder refuses to confirm transport
damage, acceptance of the delivery may be refused, as carriers/freight forwarders do not accept subsequent claims regarding transport damage.
Instructions for any necessary returns can be found under point 10, "Returns."
The seller does not accept claims from third parties who are not the postal recipients of the delivery. Any delivery addresses that differ from the
customer's address only apply to the original order. For reshipments or returns requiring a later delivery, the shipping address provided by the
customer in the shop will apply unless explicitly communicated in writing. All returns require prior agreement with GRUMANIA JETS. We refuse to accept
shipments that have not been pre-registered. The return address is ALWAYS the address stated on the invoice. Valuable parts must be returned via a transport
service commissioned by GRUMANIA JETS to ensure that any transport damage can be claimed. The customer is responsible for any damage to parts from
unregistered returns.
Important note for customers outside the EU: For shipments within the European Union, we are NOT able to refund VAT (after the customer has exported the goods).
5. Prices
The prices applicable to delivery are those in effect at the time of order confirmation or shipment of the goods. All prices are exclusive of applicable
shipping costs. Grumania Jets reserves the right to refuse delivery if price changes from its suppliers or other unforeseen circumstances constitute an
unreasonable burden. Grumania Jets will not refund VAT if the order was shipped to a German address and the goods were subsequently exported by the recipient.
6. Payment
Unless otherwise agreed, payment is due in advance; otherwise, the payment terms stated on the invoices apply. All invoices from Grumania Jets are due
without discount. Any deviations from this require a written agreement. Payment is only considered complete when Grumania Jets has received the funds.
Bills of exchange are not accepted. Grumania Jets is entitled to apply payments received from the buyer first to the oldest outstanding debt. Invoices
from Grumania Jets are considered accepted unless a written objection is received within 14 days of the invoice date. 6.1 Payment Default In the event
of payment default, all outstanding amounts owed to Grumania-Jets become due immediately. Grumania-Jets is entitled to charge default interest at a rate
of 3% above the respective German Federal Bank discount rate.
7. Default of Acceptance
If the buyer defaults on acceptance, Grumania-Jets is entitled, at its option, to either insist on acceptance or to demand 20% of the purchase price as
liquidated damages and compensation for expenses. Grumania-Jets reserves the right to claim demonstrably higher damages. The liquidated damages will be
educed to the extent that the customer proves that no expenses or damages were incurred. For the duration of the buyer's default of acceptance, Grumania-Jets
is entitled to store the goods at the buyer's risk, either on its own premises, with a forwarding agent, or in a warehouse. During the period of default of
acceptance, the buyer shall pay Grumania-Jets a flat rate of €25.00 per month for the resulting storage costs without further proof. In the event of

8. Warranty / Guarantee
The buyer has a six-month warranty on all deliveries from Grumania-Jets. It is guaranteed that the delivered goods are free from defects according to the
current state of the art. If the manufacturer provides a warranty, we assign all resulting warranty claims to the buyer. The buyer is obligated to assert
these claims first against the manufacturer, if necessary through legal action. No warranty is provided for defects and damages resulting from unsuitable
or improper use, commercial use, failure to observe operating instructions, or faulty or negligent handling. The warranty is void if the customer carries
out modifications and/or repairs to the equipment without the express consent of Grumania-Jets or by persons not authorized by the company. The company is
not liable for damages that did not occur to the delivered goods themselves, nor for willful damage to the goods, nor for lost profits or other financial
losses incurred by the buyer. If the delivered goods are defective or lack warranted characteristics, Grumania-Jets reserves the right to repair or replace
the defective goods upon return of the original goods. If Grumania-Jets is unable to repair the goods, the customer may, to the exclusion of all further claims,
demand a reduction in the purchase price or cancellation of the contract, provided Grumania-Jets has attempted to deliver a flawless product to the customer
three times. Any goodwill gesture from Grumania-Jets regarding returned goods will generally be subject to a processing fee of 10% of the goods' value. By
opening the packaging, the buyer acknowledges copyright protection. Minor deviations from the purchased item regarding quality, color, dimensions, and shape
o not constitute a defect, provided they are customary in the trade and reasonable for the customer. Dimensions of third-party products are provided by the
respective manufacturers and passed on by Grumania-Jets to the best of their knowledge and belief; however, the manufacturer is liable for deviations that
were unforeseeable for Grumania-Jets. Obvious defects, or defects not detectable upon proper inspection, must be reported in writing or with specific details
within 10 business days of receiving the goods. Otherwise, all warranty claims are excluded. In the case of justified complaints requiring rectification by
GRUMANIA JETS, GRUMANIA JETS reserves the right to take appropriate measures to ensure that the goods are free of defects. Any return shipping costs incurred
will be borne by GRUMANIA JETS.8.1 Warranty / Guarantee for Thrust Tubes Since special circumstances during installation and subsequent use of thrust tubes can lead to damage or even destruction of the thrust tube and/or the model aircraft, and since we have no control over its intended use, the installation and use of thrust tubes is generally the sole responsibility of the buyer. By purchasing a thrust tube, the buyer acknowledges that Grumania Jets is not liable for damage caused by overheating of the thrust tube. In particular, the use of so-called smoke systems always carries the risk of fire inside the tube and results in the exclusion of warranty claims. Thrust tubes ordered specifically for a model may not be used for other purposes without prior consultation with Grumania Jets. This also applies in particular to the use of a turbine not intended for this product. All our thrust tubes are intended exclusively for private and non-commercial use. Orders for commercial use should be submitted to GRUMANIA JETS via email. 8.2 Thrust tubes in the "Thrust Tubes by Aircraft Type" category are always custom-made and non-returnable. Once the order status changes to "In Process," a thrust tube order cannot be changed, as it is then manufactured specifically for the customer. At this point, customers can no longer cancel the order. 8.3 Fuel bags are custom-made / tailormade products and made to order. The order cannot be changed once the order status is updated to "In Process". Since production has either started or been completed at this point, customers can no longer cancel the order.The dimensions given are approximate and basic dimensions without seam width or protruding parts such as flanges, nipples or fasteners. Size tolerances of 5% are unavoidable in the manufacturing of flexible fuel cells and do not constitute grounds for a complaint. 9. Cancellation of Unfulfilled Orders Grumania-Jets may cancel the contract if a suspension of payments, the commencement of bankruptcy or judicial composition proceedings, the rejection of bankruptcy due to insufficient assets, or other concrete indications of a deterioration in the customer's financial situation become known.
10. Returns
All returns can only be processed upon presentation of the invoice. Grumania-Jets does not accept collect shipments. Every return requires prior
agreement with GRUMANIA JETS. We refuse to accept shipments that have not been pre-registered. The return address is ALWAYS the address stated on
the invoice. Exchanged goods in a non-resaleable condition will generally not be accepted and will be made available to the buyer again at their
expense. The customer bears the shipping costs and risk for sending exchanged goods to Grumania-Jets until they arrive at the Grumania-Jets warehouse.
The return of damaged goods resulting from transport damage can be carried out by a transport service provider commissioned by Grumania Jets so that
any transport damage can be claimed from the transport company. This excludes export shipments to customers outside the EU. Customers outside the EU
will be reimbursed for the costs of a previously agreed-upon return, but these costs must initially be borne by the customer. Damage to parts of an
unannounced/unarranged return shipment is the responsibility of the customer.
11. Retention of Title
All deliveries are subject to retention of title. They remain the property of Grumania-Jets until full payment has been received. If a third party
attempts to seize goods still owned by Grumania-Jets, in particular through attachment in enforcement proceedings, the buyer must immediately inform
the third party of Grumania-Jets' ownership and notify Grumania-Jets of the seizure, sending or handing over any relevant documents. The buyer shall
bear all costs incurred in removing the seizure and recovering the goods, unless these costs are to be borne by a third party. In the event of a breach
of contract by the buyer, Grumania-Jets is entitled to demand the return of the goods. Neither the repossession nor the attachment of the goods subject
to retention of title constitutes a withdrawal from the contract. If the purchased goods are mixed with other items not belonging to us, Grumania-Jets
acquires co-ownership of the new item in proportion to the value of the purchased goods relative to the other mixed items at the time of mixing. If the
customer's item is considered the principal item, the customer must transfer proportionate co-ownership to Grumania-Jets. The customer is entitled to
resell the goods in the ordinary course of business. However, the customer hereby assigns to Grumania-Jets all claims against its customers or third
parties arising from the resale up to the amount of the final invoice.
12. Cancellation and Compensation for Unfulfilled Orders
Grumania-Jets is entitled to cancel the contract if Grumania-Jets becomes aware of a suspension of payments, the commencement of bankruptcy or
judicial composition proceedings, or other concrete indications of a deterioration in the customer's financial circumstances. If Grumania-Jets
cancels the contract or if the order is not fulfilled for reasons attributable to the customer, the customer shall pay Grumania-Jets a flat-rate
ompensation of 10% of the purchase price to cover expenses and lost profits. This flat-rate compensation shall be reduced to the extent that the
ustomer proves that no expenses or damages were incurred. In the event of exceptionally high damages, Grumania-Jets reserves the right to claim
these. This applies in particular to cancellations by the buyer of orders for custom-made items or items that must be manufactured exclusively for
the specific order or ordered from suppliers. "Thrust tubes" are generally non-returnable, as they are always manufactured only after an order is
received and are custom-made/special orders.
13. Use of Customer Data
Grumania-Jets is authorized to process all data relating to business relationships with customers in accordance with the German Federal Data
Protection Act (BDSG).
14. Place of Performance
The place of performance for both contracting parties is the registered office of Grumania-Jets, if you are a merchant. The place of performance
is therefore 72585 Riederich, Germany.
15. Jurisdiction
If you are a merchant, the exclusive place of jurisdiction for all disputes is our registered office.
16. Disclaimer for Model Kits and Thrust Tubes The assembly of model kits and the operation of turbines and thrust tubes require special expertise and care. This applies in particular to their use. Since we cannot monitor the intended use of a model kit/thrust tube, we exclude all liability. This applies especially to any type of commercial use of these items. 17. Commercial Use The goods manufactured by Grumania Jets are exclusively for private, non-commercial use. Any type of commercial use is strictly prohibited. Exceptions require prior written agreement. Grumania Jets reserves the right to immediately reclaim any goods used commercially that were ordered for private use. The return shipping costs are borne by the customer. In the event of resale to third parties, that are commercial and/or military users, the buyer is responsible for the immediate return of the goods to Grumania Jets, as well as bearing all associated return shipping costs. Furthermore, a contractual penalty of €10,000 is agreed upon. 18. Severability If any provision of these Terms and Conditions is held to be invalid, the remaining provisions shall remain in full force and effect.
